Please read these terms carefully before using our services.
- These terms govern your use of MogiTech Global LTD services.
- We own the intellectual property for our tools; you own the IP for your custom project upon payment.
- Payment terms are strict; late fees may apply as per your specific Service Agreement.
- Disputes are resolved under the laws of the Republic of Kenya.
Welcome to MogiTech Global LTD. By accessing our website or engaging our services, you agree to be bound by these Terms of Service.
1. Acceptance of Terms
By using our Services, you verify that you are at least 18 years of age and legally capable of entering into binding contracts. If you are using the Services on behalf of an organization, you agree to these Terms on behalf of that organization.
2. Scope of Services
MogiTech Global provides technology services including but not limited to custom software development, IT consulting, networking, and digital transformation. Specific deliverables, timelines, and costs for your project will be outlined in a separate Service Level Agreement (SLA) or Project Proposal.
3. Intellectual Property Rights
Our IP: All pre-existing code, libraries, frameworks, methodologies, and tools used by MogiTech Global remain our exclusive property.
Your IP: Upon full payment of all fees, MogiTech Global assigns to the Client all right, title, and interest in the custom deliverables created specifically for the Client.
4. User Obligations
You agree not to use our services for any unlawful purpose. You are responsible for providing accurate information, timely feedback, and necessary access to your systems as required for us to perform the Services.
5. Payment & Invoicing
Unless otherwise agreed in writing:
- A deposit is required to commence work.
- Invoices are due within 14 days of receipt.
- We reserve the right to suspend services for accounts that are more than 30 days overdue.
6. Limitation of Liability
To the maximum extent permitted by law, MogiTech Global LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with our services.
7. Termination
Either party may terminate the engagement with written notice if the other party breaches a material term of the agreement. Upon termination, the Client shall pay for all work completed up to the termination date.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any significant changes by posting a notice on our website.
